Small Law Firm Series: Community Based Sentences

The Community Court was established to adopt “a problem-solving approach that combines criminal justice and community resources for a comprehensive response”. Apart from the prevention of crime and reducing the incidence of crimes, it has the additional goals of promoting rehabilitation and addressing the underlying causes of criminality.

 

The talk will highlight the sentencing considerations governing the imposition of the range of community based sentences which include the following:

  •  Reformative Training
  •  Mandatory Treatment Order
  • Short Detention Order
  • Community Service Order
  • Day Reporting Order 

 

As part of the continuum of services offered by the Community Court, the role of the Community Court Secretariat will also be highlighted which includes their involvement in the following court initiatives:

  •  Court-directed Pre-sentence protocol
  •  Progress Accountability Court Reviews
  •  Community Court Conferences (eg Victim-Offender Conference, FRENS initiative, Victim Assistance Scheme)

This series of small law firm topics will give participants new insights from the different Divisions of the State Courts on relevant and timely legal topics. In the first session, the topic will focus on how to prepare for tribunal hearings and appeals, with highlights of the newly established Employment Claims Tribunal.
