Recent Amendments to the Small Claims Tribunals Act, Employment Act and Employment Claims Act

This talk will cover the changes introduced by the Small Claims Tribunals (Amendment) Bill which was passed in Parliament on 9 July 2018. The changes include the expansion of the Small Claims Tribunals’ jurisdiction and the enhancements of the Tribunals’ powers and processes for more effective case management.

 

The talk will also cover the changes made to the Employment Claims Act (“ECA”) and Employment Act (“EA”) by the Employment Amendment Act 2018 that came into force on 1 April 2019. It will focus on the transfer of adjudication of wrongful dismissal claims from the Ministry of Manpower to the Employment Claims Tribunals as well as cover notable additional protection for employees, such as the extension of core provisions of the EA to managers and executives earning above $4,500 per month, an enhanced paid sick leave and authorised deductions regime and the extension of paid annual leave entitlements to all employees covered by the EA. It will also cover how the Employment Claims Tribunals may now draw adverse inferences from a party’s failure to comply with specified obligations under written law in the 4th Schedule to the ECA.
